Amazon Prime Terms & Conditions

Welcome to the terms and conditions ("Terms") for Amazon Prime. These Terms are between you and Amazon Services LLC and/or its affiliates ("Amazon.com" or "Us"), and govern our respective rights and obligations. The Terms, together with applicable terms and conditions related to any promotional offers provided to you for use with Prime, constitute the entire agreement between you and Amazon.com related to the Prime membership. Please note that your use of the Amazon.com Web site and Prime membership are also governed by our Conditions of Use and Privacy Notice, as well as all other applicable terms, conditions, limitations and requirements on the Amazon.com Web site, all of which (as changed over time) are incorporated into these Terms. If you sign up for a Prime membership, you accept these terms, conditions, limitations and requirements. Please read these Terms carefully.
Membership Benefits
Prime members are entitled to FREE Two-Day shipping and $3.99 per unit One-Day shipping on all eligible purchases. There is no minimum purchase requirement. Two-Day and One-Day shipping usually apply across business days; however, Amazon Prime members can take advantage of special weekend and other shipping options for qualifying merchandise--these options depend on inventory availability, order deadlines, and in some cases on the shipping address.
If you sign up for a Prime membership, you may invite up to four eligible household members living in your household (at the same address) to enjoy your Prime membership at no extra cost. (Please note that any member under age 18 may use the Amazon.com Web site only with involvement of a parent or guardian.) If you purchase a Prime membership for use by an Amazon corporate account, you may invite up to four eligible coworkers to shop for this corporate account consistent with these Terms and Conditions. The purchaser can change and/or remove invitees at any time. A guest's membership will automatically terminate if the purchaser of the membership ceases to be a member or removes the invitee.
Eligible Purchases
Prime is limited to certain products sold by Amazon.com (or third-party merchants participating in the Fulfillment by Amazon program) on www.amazon.com that are shipped to continental United States addresses, excluding Alaska, Hawaii, P.O. boxes, APO/FPO and U.S. territories, possessions and protectorates.
Though Two-Day and One-Day shipping benefits do not apply to these excluded addresses, members are entitled to free Standard shipping on eligible items shipped to P.O. boxes in the continental U.S. and APO/FPO addresses with U.S. zip codes. Certain products may only be eligible for free Standard shipping because of their size, weight or other shipping characteristics. We may exclude products with special shipping characteristics at our discretion. Products are eligible for Prime only if designated on the website. Products sold and fulfilled by third parties, or through third-party areas such as Marketplace and/or Auctions, are NOT eligible for Prime. Prime members are not permitted to purchase for the purpose of resale or to ship to their customers or potential customers using Prime benefits.
Conditions
You must have an Amazon.com account to sign up for and use Prime. We reserve the right to accept or refuse membership in our discretion. You may not transfer or assign your Prime membership or these benefits, except as part of our household invitee program described above. Some special product, order, handling fees and/or taxes may still apply to eligible purchases. If only some items in your order are eligible for Prime, you will pay applicable shipping charges for the ineligible items. Changing or combining orders, or changing your shipping address, speed, or preferences might affect Prime eligibility. Please note:
One-Day and Two-Day shipping are terms we use to determine your estimated delivery date (these terms do not reflect product availability or our estimated shipping date);
We may ship the products by ground or air at our discretion (these terms do not correspond to any carrier-branded shipping services);
Our carriers usually do not pick-up or deliver packages on weekends or holidays (though Amazon Prime members are eligible for special weekend and other shipping options on qualifying merchandise);
We do not guarantee delivery of products within the estimated transit time or by the estimated delivery date.
Prime is not available for members who purchase products for the purpose of resale or use Prime to ship products to their customers or potential customers.
Fees and Renewal
The annual membership fee for Prime is $79.00. From time to time, we may offer different subscriptions terms, and the membership fees for such subscriptions may vary. Only credit cards are eligible for payment of your Prime membership. Do not sign up for Prime with a debit card. Also known as a "check" or "ATM" card, a debit card typically has the word "debit" printed on the face of the card. MasterCard uses a unique debit hologram above the MasterCard logo. Visa identifies its debit cards as check cards and prints the word debit above the Visa logo. The Prime membership fee is non-refundable except as expressly set forth below. Taxes may apply on either or both of the membership fee and the reduced shipping charges for Prime.
If your Prime membership is renewed within 30 days of when your Prime benefits end, the new membership period will be extended for a new term from the original renewal date. Memberships renewed after 30 days of when your Prime benefits end will be extended for a new term from the day you are charged.
UNLESS YOU NOTIFY US BEFORE RENEWAL THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR PRIME MEMBERSHIP WILL AUTOMATICALLY RENEW AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU) TO COLLECT THE THEN-APPLICABLE ANNUAL MEMBERSHIP FEE AND ANY TAXES, USING ANY CREDIT CARD WE HAVE ON RECORD FOR YOU.
Membership Cancellation
If you cancel your Prime membership before you or your registered guests have made any eligible purchases, we will refund your full membership fee.
Promotional Trial Memberships
We sometimes offer certain customers various trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional offers. Trial memberships cannot be canceled, but trial members can at any time (through Your Account) choose not to upgrade to regular annual membership at the end of the trial period.
Agreement Changes
We may in our discretion change these Terms, Amazon.com's general Conditions of Use and Privacy Notice, or any aspect of Prime membership, without notice to you. However, any increase in the membership fee will not apply until your membership is renewed. Also, if we increase the charges for the core One-Day and Two-Day Shipping options, or decrease the number of family members who can be invited as guests, we will notify you by email at least 30 days before the new terms go into effect. If you cancel your Prime membership before the effective date of these changes, we will give you a prorated refund of your membership fee. This refund option does not apply to any other changes we may make. If any change is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.
Termination by Us
We may terminate your Prime membership at our discretion without notice. If we do so, we will give you a prorated refund based on the number of full months remaining in your membership. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Prime membership, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.
Limitation of Liability
IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN AMAZON.COM'S CONDITIONS OF USE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO PRIME. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST ANNUAL MEMBERSHIP FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR PRIME MEMBERSHIP. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
